This Privacy Policy explains how Padelnation PTY LTD ("PadelNation", "we", "us" or "our") collects, uses, stores, shares and protects personal information. It applies to our Website, enquiries, customers, suppliers, event participants, club users and other persons who interact with PadelNation, except where a separate privacy notice expressly applies.

Personal information we may collect

Depending on how you interact with us, we may collect identification and contact information; enquiry and correspondence details; booking or event information; company and billing information; transaction references; technical and device information; website usage and cookie information; photographs or video where appropriate; supplier or contractor details; and any other information you choose to provide.

Where reasonably necessary for a specific purpose, we may also process information relating to employees, contractors or authorised representatives of customers and suppliers. We do not intentionally collect special personal information unless it is lawful, necessary and appropriate for the relevant purpose.

How we collect information

We may collect information directly from you through the Website, email, telephone, WhatsApp, event or project interactions; from organisations you represent; from booking or other service providers where lawful; from publicly available sources; and automatically through website technologies such as cookies, analytics and server logs.

Why we process personal information

We process personal information only where there is a lawful basis and for legitimate, specified purposes. These may include responding to enquiries; preparing quotations and proposals; performing contracts; managing court projects and maintenance; facilitating bookings and events; administering customer and supplier relationships; providing support; invoicing and accounting; fraud and security prevention; legal and regulatory compliance; improving our Website and services; and sending marketing where permitted by law.

Where we rely on consent, you may withdraw it at any time, without affecting processing that was lawful before withdrawal. In other cases we may process information because it is necessary to perform a contract, comply with law, protect a legitimate interest or pursue our legitimate business interests in a manner consistent with POPIA.

Playtomic and other third-party platforms

Court bookings are primarily facilitated through third-party platforms such as Playtomic. When you use a third-party platform, that provider may independently collect and process your information under its own privacy notice and terms. PadelNation may receive booking or customer information from the platform to the extent necessary to operate the relevant venue, administer your booking, provide support, handle disputes or comply with law.

We may also use hosting, communications, analytics, accounting, professional-adviser, payment, IT security and other service providers. They may process personal information only to the extent required for the relevant service and subject to appropriate contractual or legal safeguards.

PadelClubIQ

PadelClubIQ is a separate PadelNation software offering. Where PadelClubIQ has its own privacy terms or data-processing arrangements, those apply to information processed specifically through that platform. This Privacy Policy continues to apply to PadelNation’s own corporate, marketing and Website processing unless a more specific notice applies.

Cookies and analytics

Our Website may use cookies and similar technologies needed for functionality, security, preferences, analytics or performance. Where required, non-essential cookies will be used subject to appropriate notice or consent. You can manage cookies through your browser and, where available, the Website’s cookie controls. Blocking some cookies may affect Website functionality.

Direct marketing

We may send marketing about PadelNation products, venues, events or services where permitted by law. Where consent is required, we will seek it. You may opt out at any time using the unsubscribe method in a communication or by contacting us at privacy@padelnation.co.za. Service or transactional messages that are necessary to manage an existing relationship are not treated as marketing merely because they are sent electronically.

Sharing of personal information

We may share personal information with authorised staff; companies or service providers supporting our operations; booking platforms; professional advisers; insurers; banks or payment providers; contractors involved in a project; regulators, law-enforcement bodies or other authorities where required; and a purchaser or successor in connection with a lawful business transaction.

We do not sell personal information as a standalone commercial product.

Cross-border processing

Some service providers or technology systems may process or store information outside South Africa. Where personal information is transferred across borders, we take reasonable steps to ensure that the transfer complies with section 72 of POPIA, including by relying on adequate protection, binding agreements, consent where appropriate, or another lawful basis.

Security safeguards and incidents

We take appropriate, reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised destruction, unlawful access or unlawful processing. Measures may include access controls, authentication, backups, security monitoring, vendor controls and staff confidentiality obligations appropriate to the risk.

If we have reasonable grounds to believe that personal information has been accessed or acquired by an unauthorised person, we will manage and notify the incident as required by POPIA and applicable guidance.

Retention

We retain personal information only for as long as needed for the purpose for which it was collected, to meet contractual or legal obligations, to resolve disputes, or where retention is otherwise permitted by law. We may securely delete, destroy or de-identify information when it is no longer required.

Your rights

Subject to POPIA and PAIA, you may ask whether we hold personal information about you; request access to it; request correction or deletion where the legal requirements are met; object to certain processing; withdraw consent where consent is the basis for processing; and complain to the Information Regulator.

Requests should be sent to privacy@padelnation.co.za. We may need to verify your identity before acting on a request. Access to records may also be subject to the procedure and lawful grounds for refusal in PAIA.

Children

Our general Website is not directed at children. Where children participate in padel activities or events, personal information should be provided by or with appropriate authorisation from a parent, guardian or other competent person where required by law. We process children’s information only where a lawful basis exists.

Third-party websites

Links to third-party websites or services are provided for convenience. Their privacy practices are governed by their own notices, and we encourage you to review them before providing personal information.

Changes to this Policy

We may update this Privacy Policy to reflect changes in law, technology or our operations. The current version will be published on our Website with its effective date.
